Wave & Wake Terms of Use

1. Who we are
Wave & Wake is an online marketplace for advertising boats for sale, operated by Suibhne Ltd, a company registered in England and Wales (company number 17300594), trading as "Wave & Wake" ("Wave & Wake", "we", "us", "our").

By accessing or using the website at waveandwake.com (the "Site") you agree to these Terms of Use. If you do not agree, please do not use the Site.
2. What Wave & Wake is, and is not
Wave & Wake is an advertising platform. We provide a place for sellers to advertise boats and for buyers to find them.
We do not:
- buy, sell, own, store, inspect or take possession of any boat;
- act as broker, agent, auctioneer or dealer in any transaction;
- take a commission on any sale;
- handle, process or hold payment for any boat;
- form part of, guarantee, or take responsibility for any transaction between a buyer and a seller.
Any sale of a boat is a matter solely between the buyer and the seller. We are not a party to it.
3. Using the Site
- Much of the Site (searching, viewing listings, seeing seller type and business names) is open to everyone without an account.
- Some actions require an account: saving searches, saving favourites, advertising a boat, and contacting a seller.
- You must be at least 18 years old to create an account or advertise a boat.
- You agree to use the Site only for lawful purposes and not to misuse it, for example by introducing malicious code, attempting unauthorised access, interfering with other users, scraping or bulk-extracting data (including for the training of machine-learning models), or circumventing any technical protection we apply.
4. Accounts
- You are responsible for the accuracy of the information you give us and for keeping your login details secure. Two-factor authentication is available on every account and we encourage you to turn it on.
- You are responsible for activity that happens under your account.
- Tell us promptly if you believe your account has been accessed without your permission.
- You can close your account yourself from your account settings. A 30-day grace period applies before permanent deletion, as described in our Privacy Policy.
- We may suspend or close an account that breaches these Terms or any other terms or policies posted on the Site.
5. Content and listings
- Sellers are responsible for their own listings and content, including photographs and video. We do not verify, endorse or guarantee the accuracy, quality, legality or safety of any boat or any statement in a listing.
- You must have the right to advertise any boat you list and the right to use any text, photographs, video or other material you upload.
- You must not post anything false, misleading, defamatory, obscene, unlawful, or that infringes anyone else's rights.
- If you use our AI drafting tool to generate a listing description, the output is a draft for you to check and edit. The published listing is your content and your responsibility, whether or not the tool was used.
- We may remove, edit or refuse any listing or content at our discretion, including where we believe it breaches these Terms or the law. Where we remove a paid listing other than for your breach, we will deal with any unused paid period fairly (see the relevant seller terms).
6. Buyer responsibility and safety
- Listings are created by sellers and third parties. We make no warranty as to the completeness or accuracy of any listing.
- You are responsible for your own due diligence before buying, including inspecting the boat, verifying ownership and identity (such as the HIN), confirming condition, and taking independent advice (survey, finance, insurance) where appropriate.
- When you send an enquiry through the Site, your message and the contact details you include are passed to the seller so they can reply to you. See our Privacy Policy for how that works.
- Take sensible precautions when dealing with people you meet through the Site. If something looks suspicious or fraudulent, please report it to us.
7. Reporting content, and complaints
- If you believe a listing or other content on the Site is illegal, fraudulent, infringes your rights, or breaches these Terms, report it to us at support@waveandwake.com or using the reporting option on the listing. Include enough detail for us to find and assess the content.
- We review reports and take the action we consider appropriate, which may include removing content, suspending accounts, and, where the law requires, notifying authorities.
- If you disagree with a decision we have made about content or about your account, you can raise a complaint at support@waveandwake.com and we will review it.
8. Partner services and introductions
From time to time we may show clearly-labelled introductions to third-party partners (for example finance, insurance, marine survey or transport providers).
- These services are provided by the partners, not by Wave & Wake, and are subject to the partner's own terms.
- Partner introductions are firewalled from search: paying us, or a partner paying us, never affects where a boat appears in results.
- We do not pass your personal information to partners. If you choose to take up a partner service, you do so by going to the partner directly and providing your details to them yourself. See our Privacy Policy.
- We are not responsible for partner services and do not give regulated financial or insurance advice.
9. Our intellectual property
The Site, its design, the "Wave & Wake" name and logo, and the database of listings (as compiled by us) are owned by or licensed to us. You may use the Site for your own personal, non-commercial purposes and to advertise boats in accordance with the relevant seller terms. You may not copy, scrape, republish or exploit the Site or its database except as we expressly permit.
10. Your content licence to us
When you upload content to a listing, you grant us a non-exclusive, royalty-free licence to host, display, reproduce and distribute that content for the purpose of operating and promoting the Site and your advert. You keep ownership of your content. The licence ends when the content is deleted from the Site, except for copies held in routine backups and records we retain in line with our Privacy Policy.
11. Availability, changes and liability
- We aim to keep the Site available but do not guarantee uninterrupted access, and we may change, suspend or withdraw parts of the Site.
- We may update these Terms from time to time. If we make a material change we will take reasonable steps to bring it to your attention, and continued use after the change means you accept the updated Terms. (For business sellers, the notice provisions in the Business Terms apply.)
- Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or for fraud).
- Subject to that, we are not liable for: the acts or content of sellers, buyers or partners; any transaction between users; or indirect or consequential loss. The Site is provided "as is" and "as available".
- If you use the Site in the course of a business, then subject to the paragraph above about liability that cannot be limited: our total aggregate liability to you in any 12-month period is limited to the fees you paid us in that period, and we are not liable for loss of profit, revenue, business, goodwill or data.
12. General
- If any part of these Terms is found unenforceable, the rest continues to apply.
- If we do not enforce a right under these Terms, that is not a waiver of it.
- We may transfer our rights and obligations under these Terms to another organisation (for example if the business is sold); we will tell you if this happens and your rights will not be reduced as a result.
- These Terms, the Privacy Policy and any seller terms you accept are the terms that apply between us for your use of the Site.
13. Governing law
These Terms, and any dispute relating to them or to the Site, are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. Nothing here affects your mandatory legal rights as a consumer.
