Wave & Wake Private Terms

These Private Advertising Terms apply when you advertise a boat as a private seller on Wave & Wake. They are in addition to our Terms of Use and Privacy Policy, which also apply. By placing an advert you accept these terms, and each advert you place is a separate agreement between you and us.
1. Who can advertise as a private seller
- You must be at least 18 and have an account.
- You must be selling your own boat (or be authorised to sell it) in a private capacity, not in the course of a business.
- If you are a business, a trader, or otherwise selling boats commercially, you must use a business account, not a private advert. UK law (including the Digital Markets, Competition and Consumers Act 2024) requires sellers acting in the course of business to make that clear, and you must not present yourself as a private seller when you are not.
2. What you're buying
- A private advert is a paid listing for a single boat for a fixed term, according to the tier you choose (for example Bronze, Silver or Gold). The price, duration, photo and video allowances and features of each tier are shown at the point of purchase.
- It is a one-off payment for advertising time. There is no commission on any sale, and there are no paid "boosts": additional prominence comes only from the tier you choose.
- When a term ends you may extend it, and certain tiers may qualify for a continued "still for sale?" phase, as described at the time.
3. Your right to cancel (consumers)
- Because you buy your advert online, you have a legal right to cancel within 14 days of purchase under the Consumer Contracts Regulations 2013.
- At checkout we ask you to expressly request that your advert is published straight away, without waiting for the 14-day period to end, and to acknowledge what that means for your cancellation right.
- If you cancel within the 14 days while your advert is live, we refund the price less a proportionate amount for the time the advert has already been live. Once the advertising term you bought has been fully performed, the right to cancel no longer applies.
- To cancel, contact us at support@waveandwake.com or use the cancellation option in your account.
- This section does not limit your other statutory rights, including where the service is not carried out with reasonable care and skill.
4. Your listing: accuracy and responsibility
- Your advert and all its content are your responsibility. You must make sure the information is accurate, honest and not misleading, and that you have the right to sell the boat and to use any photographs, video or material you upload.
- You must describe the boat fairly, including material faults you are aware of, in line with your obligations to consumers and under consumer-protection law.
- You must not advertise a boat you do not own or are not authorised to sell, or list the same boat in a way designed to mislead.
5. Boat location
- Adding a location to your advert is optional. If you add one, the exact point you place on the map is published publicly on the listing and the map search, and the Site tells you this before you choose. Place it on your mooring, or on a sensible nearby spot on the same water if you prefer. See our Privacy Policy, section 4, for the full explanation.
6. AI drafting tool
- If you use the AI drafting tool to generate a listing description, the output is a draft only. You must check and edit it before publishing. The published description is your content and your responsibility, and section 4 applies to it in full.
7. The identity lock (anti-swap)
To protect buyer trust, certain identity details of a listing, including make, model, year, length, HIN, engine configuration, auxiliary engine presence, and the main photo, become locked a short time after the advert is first published (a 7-day grace window applies, during which you can freely correct them).
- This stops a sold advert being quietly reused for a different boat.
- After the lock, price, description, status and additional photos remain editable, but genuine mistakes in locked fields are handled through a request-a-correction process rather than self-service editing.
8. Contact and conduct
- When buyers contact you, their message and contact details are shared with you so you can reply. Use their details only to deal with their genuine enquiry about your boat, and do not add them to any marketing list.
- Deal honestly and lawfully. Do not use the Site to send spam, harass anyone, or carry out or facilitate fraud.
9. Removal, suspension and refunds
- We may remove or suspend an advert that breaches these terms, the Terms of Use, or the law, including where you are a trader posing as a private seller, where a listing is misleading, or following a credible report.
- If we remove a paid advert for your breach, we are not obliged to refund the unused period.
- If we remove a paid advert for reasons other than your breach, we will deal fairly with any unused paid period.
10. Payments
- Advertising fees are payable at the point of purchase (and at the point of any extension) by the methods we offer. Card payments are processed by Stripe; we never see or store your card details.
- Prices are shown inclusive of any applicable taxes where required.
- Your statutory rights as a consumer are not affected.
11. Our role
Wave & Wake advertises your boat; it does not sell it. Any sale is solely between you and the buyer. We are not a party to the sale, take no commission, and handle no payment for the boat itself. Our Terms of Use (including the limits on our liability) apply.
12. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. Your mandatory rights as a consumer are not affected.
