Wave & Wake Business Terms

These Business Terms apply to business and trade sellers on Wave & Wake, including brokers, dealers, marinas and boatyards. They are in addition to our Terms of Use and Privacy Policy, which also apply.
1. Opening a business account
- You confirm that you are acting in the course of a business and that you have authority to open and operate this account on behalf of the business named in it.
- You agree to provide accurate business details, including the name and job title of the person registering, business name, business address, business registration / VAT number where applicable, business email and phone, and business type, and to keep them up to date.
- You confirm the business is entitled to sell, or to act in the sale of, the boats it advertises, and will comply with all laws and regulations that apply to its trade (including consumer-protection, advertising and, where relevant, financial-promotion rules).
2. How business advertising works: the berth model
- Business sellers buy capacity, not fixed-term adverts. A berth is one live listing slot; a listing stays live until the boat sells or is withdrawn. There is no per-listing clock or per-listing fee, and no commission.
- Plans provide a number of berths and a number of featured slots, billed monthly or annually, as shown at the point of purchase. Additional temporary "top-up" berths may be available.
3. Ranking and visibility
- Search results are ordered mainly by how well a listing matches what the buyer searched for: the buyer's search terms, filters and sort choices (for example price, length, year or distance), together with the completeness and recency of the listing.
- Featured placement is the only premium visibility lever, and featured slots come with your plan. Featured listings are displayed with distinct prominence and are identifiable as featured. There are no à-la-carte paid boosts; more featured placement means moving up a plan.
- Beyond plan-included featured placement, no payment by you, by any other seller, or by any partner affects where a listing appears in results.
- We do not sell boats ourselves and we do not give any business we are connected with preferential treatment in ranking or visibility.
4. Your listings: accuracy and trade obligations
- The business is responsible for its listings and content, for their accuracy, and for having the right to advertise each boat and to use any material uploaded.
- As a trade seller you must comply with your legal obligations to consumers, including describing boats fairly and not misleadingly, and clearly being identifiable as a trade seller (as required by UK law, including the Digital Markets, Competition and Consumers Act 2024).
- If your users use the AI drafting tool, its output is a draft; the published listing is the business's content and responsibility.
- You must not misuse private-seller advertising to avoid business terms or fees.
5. The identity lock (anti-swap)
The same identity lock that applies to private listings applies to business listings: identity details (make, model, year, length, HIN, engine configuration, auxiliary engine presence, and the main photo) lock after a short grace window to prevent a sold advert being reused for a different boat. Price, description, status and additional photos remain editable; locked-field corrections go through the request-a-correction process.
6. Multiple users
- A business account may have more than one user, with roles (for example an administrator who can manage the account, and members). The business is responsible for the actions of all its users and for managing their access.
7. Account standing and verification
- We may display business information (such as the trading name and type) to buyers.
- We may introduce checks or a verification step for business accounts. Providing false business information, or misusing the account, may lead to suspension or closure under section 10.
8. Payments and term
- Plan fees are payable in advance (monthly or annually) by the methods we offer, and continue until cancelled in accordance with the cancellation terms shown at purchase. Card payments are processed by Stripe.
- Prices are shown inclusive of any applicable taxes where required.
9. Changes to these terms and to plans
- If we change these terms, or change plan pricing or features in a way that affects you, we will give you at least 15 days' notice before the change takes effect, and longer where the change requires you to make significant adaptations. Changes do not apply retroactively and do not affect a period already paid for.
- You may end your plan before a change takes effect if you do not accept it.
- Shorter or no notice applies only where we are subject to a legal or regulatory obligation to change the terms in a way that prevents notice, or where a change is needed to address an unforeseen and imminent danger such as fraud, malware or a security risk.
10. Suspension, removal and refunds
- We may remove or suspend listings, restrict features, or suspend or terminate an account that breaches these terms, the Terms of Use, or the law, or following a credible report.
- If we restrict or suspend your listings or account, we will give you a statement of the reasons at or before the time we act. If we terminate your account entirely, we will give you at least 30 days' notice and a statement of reasons, except where a legal or regulatory obligation requires otherwise, where you have repeatedly infringed these terms, or where continuing would cause harm we reasonably need to prevent. You can challenge our decision through section 12.
- Where we act because of the business's breach, we are not obliged to refund. Where we act for other reasons, we will deal fairly with any unused paid period.
11. Your data and our data
- You can export the data connected with your business account, including your listings and the enquiries you have received, from your account settings at any time.
- We hold the data described in our Privacy Policy. We also retain aggregated or anonymised market data derived from listings (for example pricing trends), which does not identify the business or any individual, and which we may continue to use after your account ends.
- We do not provide your non-public account data to other sellers.
12. Complaints
If the business has a complaint about these terms, a ranking issue, a suspension or removal decision, or anything else about the service, contact us at support@waveandwake.com. We will consider the complaint properly and respond within a reasonable time.
13. Partner services
Any partner introductions shown on the Site are provided by the partners, not by Wave & Wake, are firewalled from search ranking, and never result in us passing your or a buyer's personal data to a partner. See the Terms of Use and Privacy Policy.
14. Our role and liability
Wave & Wake advertises boats; it does not sell them, take commission, or handle payment for the boats themselves. Any sale is between the seller and the buyer. The limits of liability in our Terms of Use apply, including the business-user liability cap. Because you contract with us in the course of a business, certain consumer protections do not apply.
15. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
